The African Pride “Yes, You Can.” Sweepstakes is sponsored by Roux Laboratories, Inc. d/b/a Colomer USA (“Sponsor”). Sweepstakes runs from June 15, 2009, at 12:01 a.m. E.S.T. to December 31, 2009, at 11:59 p.m. E.S.T. The geographic area of this promotion is the United States, excluding Puerto Rico, and Guam. Limit one entry per person. By participating in this Sweepstakes, participants agree to be bound by these Official Rules and the decisions of Sponsor, which shall be final in all respects. Sweepstakes is void where prohibited, penalized or otherwise restricted by law. All federal, state, and local laws, rules and regulations apply.
TO ENTER
There are two ways to enter. Method #1: fill out the sweepstakes entry card found in specially marked African Pride Miracle Deep Conditioning No-Lye Relaxer Systems and mail the entry card to the address indicated on the card. You must fill out the official entry card and provide the necessary information completely. Method #2: mail a send a 3½” x 5” card, with your name and address, including city, state, zip code, daytime telephone number, and e-mail address, to: The African Pride “Yes, you can” Sweepstakes, P. O. Box 37557, Jacksonville, FL 32236. Each postcard must be mailed separately and must be postmarked between June 15, 2009, and December 31, 2009, and received by January 7, 2010. Photocopied, illegible, or mechanically reproduced entries are not eligible. All entries become the property of the Sponsor and will not be returned or acknowledged. Sponsor is not responsible for lost, late, delayed, undeliverable, misdirected, postage-due mailed entries, mutilated, or incomplete entries, or for entries that for any reason are not received by Sponsor by the stated deadline. All entry information becomes the property of Sponsor and will not be returned or acknowledged.
PRIZES/ODDS of WINNING
Two (2) Prizes will be awarded. The Prize Winners will each receive a trip to Washington D.C. for two (2) people including one (1) winner and up to one (1) additional guest. Each Prize includes roundtrip coach air transportation for two (2) from the major airport nearest Winner’s residence to Washington D.C., hotel accommodations for two (2) nights, and $500 in cash. Sponsor is not liable for any expenses incurred as a consequence of a flight cancellation or flight delay. The retail value of each Prize will vary depending on each Prize Winner’s geographic location and is approximately valued at $2,000.
Odds of winning will be determined by the number of eligible entries received. No prize transfer or cash redemption permitted. No prize substitution, in whole or in part, except by Sponsor due to prize unavailability, safety or security considerations, or any other reason as solely determined by Sponsor in which case a prize of comparable or greater value will be awarded.
PRIZE RESTRICTIONS
All details of prizes shall be at Sponsor’s sole discretion, including, without limitation, Prizes are not redeemable for cash and may not be extended, transferred or substituted, except that Sponsor may substitute a prize (or portion thereof) of equal or greater value when necessary, as determined in its sole discretion. Winner is responsible for any federal, state or local taxes that may apply to prize. Any portion of prize not used by the winner will be forfeited.
WINNER SELECTION AND NOTIFICATION
Subject to the eligibility requirements on these Official Rules, prize winners will be selected as follows: On January 10, 2010, or within a reasonable time thereafter, two (2) Prize Winners will be selected by random drawing from all entries received by January 7, 2010. Odds of winning depend on the number of entries received.
On January 10, 2010, or within a reasonable time thereafter, Winners will be notified by phone, email, postal mail or express mail at Sponsor’s sole discretion. (“Winner Notification”). Together with the Winner Notification email, Winners will be sent an affidavit of eligibility and release, which, among other provisions releases Sponsor, affiliates, and suppliers from any and all liability related to this Sweepstakes or use or acceptance of the prize. Winner must execute the affidavit and release without making changes and return such requested documents to Sponsor within ten (10) calendar days from the date on the Winner Notification email. Failure of Sponsor to receive a properly executed release within 20 days will result in disqualification and forfeiture of the prize. Winners may be required to furnish additional proof of eligibility or to sign other legal documents (including tax forms). If a Winner is disqualified or otherwise determined to be ineligible, Sponsor will select an alternate Winner using the above criteria. The alternate Winner must satisfy all eligibility requirements.
ELIGIBILITY
To enter you must be a U.S. citizen or permanent legal resident, you must reside in the United States (excluding Puerto Rico, and Guam), and you must be 18 years of age or older as of June 15, 2009, as confirmed on a valid government-issued photo identification. Employees of Sponsor, and their immediate family members, and employees of Sponsor’s parents, affiliates, subsidiaries, related companies, franchisees, agents, advertising and promotional agencies, and their immediate family members, are not eligible. “Immediate family” includes only spouses, parents, siblings and children.
LIABILITY RELEASE
By entering the Sweepstakes, each participant agrees (a) to follow these Official Rules and (b) to release, discharge, and hold harmless Sponsor, and its parents, affiliates, subsidiaries, related companies, franchisees, agents, advertising and promotional agencies, together with the present and future directors, officers, agents, employees, representatives, and successors and assigns of each of them, from any and all claims, demands, damages, and liability for any injuries, loss or damage of any kind to person, including death and property, arising in whole or in part, directly or indirectly, from acceptance, possession, or use of the prize, any related promotional activity, or participation in this Sweepstakes.
DISPUTES
Participants agree that (1) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes but in no event attorneys' fees; and (3) under no circumstances will any participant be permitted to obtain any award for, and participant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
MISCELLANEOUS
Void where prohibited. Sponsor is entitled to interpret these Rules as needed and its decisions are final. Proof of sending an entry will not be deemed to be proof of receipt by Sponsor. Sponsor reserves the right to correct typographical, clerical or printing errors in any sweepstakes materials. If, due to an infection by a computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or for any reason beyond Sponsor’s control, this Sweepstakes is not capable of being run fairly or securely, Sponsor reserves the right, at its sole discretion, to terminate, modify or suspend the Sweepstakes. In such event, Sponsor will award the prizes using all non-suspect entries received as of the time of cancellation, termination, modification or suspension. No more than the stated number of prizes will be awarded. In the event that production, technical, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims. Sponsor reserves the right, at its sole discretion, to disqualify any individual it reasonably suspects or believes to be tampering with the entry process, or to be acting in violation of these Rules. Any person attempting to defraud or tamper with this Sweepstakes in any way will be ineligible for prizes and may be prosecuted to the full extent of the law.
PUBLICITY RELEASE
By accepting a prize, winner consents to the use of his or her name, photograph, likeness, biographical information and voice in this and future promotions and publicity without further compensation, except where prohibited.
LIMITATION ON LIABILITY
Sponsor is not responsible for lost, delayed, undeliverable, stolen, misdirected, or incomplete entries, or for entries that for any reason are not received by Sponsor by the stated deadlines. Sponsor, its parents, subsidiaries and affiliates, and their consultants, agencies and employees, shall not be responsible for incorrect, inaccurate or incomplete transcription of entry information; for lost, stolen, late, or misdirected entries; for destruction or alteration of entries; for unauthorized access to entries; or for any human error, technical malfunction, delay in operation or transmission, lost data, omission, interruption, deletion, defect, communications line failure, computer equipment, software, inability to access any web site or online service, or any other error or malfunction. Sponsor is not responsible for any liability or damage of any kind related to this Sweepstakes.
CHOICE OF LAW/VENUE
In the event of litigation, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the participants and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Florida without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Florida. Any legal proceedings arising out of this Sweepstakes or relating to these Rules shall be instituted only in the federal or state courts located in the State of Florida, County of Duval, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these Rules. The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
